These Terms of Use (“Terms”) are a contract between you and FundLink Tech (“FundLink Tech,” “we,” “us”). They apply to the FundLink Tech web application and related portals (the “Service”). If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization, and “you” includes that organization.

1. Agreement
By signing in, connecting Google, submitting an application, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
FundLink Tech provides software for business funding operations, including:
- Merchant application intake, document collection, and underwriting workflows.
- Offers, contracts, disbursements, and ACH schedules.
- Organization settings, roles, and a shared Gmail inbox for viewing and ingesting application emails.
- Broker and merchant portals where those features are enabled.
The Service is a professional business tool. It is not consumer banking, not legal advice, and not a public marketplace. Funding decisions, if any, are made by the funding organization according to its own credit policies.
3. Accounts and organizations
- You must provide accurate account information and keep credentials confidential.
- Each organization is responsible for who it invites, which roles it assigns, and what those users can see — including the shared Gmail inbox.
- You must select the correct organization in the header before connecting Gmail or acting on applications.
- We may suspend access for security, abuse, or non-payment of any platform fees your organization has agreed to separately.
4. Gmail connection
If you click “Connect organization Gmail,” you authorize FundLink Tech to access the Google account you select, using the scopes shown on Google’s consent screen (currently full mailbox access via https://mail.google.com/ and your Google email address). That access is used only as described in our Privacy Policy: View Emails and ingesting application attachments for that organization.
- Connect only an inbox your organization is allowed to use for funding operations (typically a shared applications mailbox, not a personal mailbox unless that is intended).
- You can disconnect at any time from Organization Settings or from your Google Account permissions.
- You are responsible for Google’s terms as well as these Terms.
- We do not warrant uninterrupted Google access. Google may revoke tokens, change APIs, or require re-consent.
Our use of Google user data complies with the Google API Services User Data Policy, including Limited Use, as stated in the Privacy Policy.
5. Your content
You retain rights to merchant files, emails, and documents you submit. You grant FundLink Tech a limited license to host, process, display, and transmit that content solely to operate the Service for your organization (including sharing with payment and document processors you enable).
You represent that you have all rights needed to submit that content and to connect any mailbox, and that doing so does not violate privacy, confidentiality, or other law.
6. Acceptable use
You will not:
- Probe, disrupt, or overload the Service, or bypass access controls.
- Use another organization’s data without authorization.
- Upload malware or unlawful content.
- Use Gmail access for any purpose other than the organization’s funding operations in the Service.
- Misrepresent identity, EIN, bank accounts, or funding status.
7. Third-party services
The Service may connect to Google, Plaid, GoACH, Actum, e-sign, email delivery, and similar providers. Their terms and privacy policies apply to their processing. FundLink Tech is not responsible for outages or changes by those providers.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that underwriting results, document parsing, or Google sync will be error-free or complete.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNDLINK TECH AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING FROM THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM (IF ANY).
Some jurisdictions do not allow certain limits; in those cases the limit applies to the fullest extent allowed.
10. Indemnity
You will indemnify and hold harmless FundLink Tech from claims arising out of your content, your Gmail connection, your organization’s users, or your violation of these Terms or applicable law.
11. Term and termination
These Terms apply while you use the Service. You may stop using the Service and disconnect Google at any time. We may suspend or end access if you materially breach these Terms. Sections that should survive (including 5–10 and 12) will survive termination. Application files may be retained as required for servicing and law.
12. Governing law
These Terms are governed by the laws of the United States and the state in which FundLink Tech maintains its principal place of business, without regard to conflict-of-law rules. Courts in that state will have exclusive jurisdiction, except that we may seek injunctive relief in any venue.
